WHAT ARE COOKIES?

Cookies are small data files that are received on the user’s device from the website visited and are used to record certain browsing interactions on a website by storing data that can later be updated and retrieved. These files are stored on the user’s device and contain anonymous data that are not harmful to their equipment. They are used to remember user preferences, such as the selected language, login details, or the customization of the website or App.

1. WHY DO WE USE COOKIES?

2. WHAT USE DO WE MAKE OF THE DIFFERENT TYPES OF COOKIES?

According to their purpose:

  • Technical cookies: these are cookies that allow the user to browse through a website, platform, or application and to use the different options or services available. For example, cookies used for session maintenance, response time management, performance, option validation, the use of security elements, or content sharing.
  • Preference or personalization cookies: these cookies allow information to be remembered so that the user can access the service with certain features that may differentiate their experience from that of other users, such as the language, the number of results to be displayed when the user performs a search, or the appearance or content of the service depending on the type of browser used or the region from which the service is accessed.
  • Analytics or measurement cookies: these cookies allow the controller to monitor and analyze the behavior of users of the websites or Apps to which they are linked, including the measurement of advertising impacts. The information collected through this type of cookies is used to measure the activity of websites, applications, or platforms, in order to introduce improvements based on the analysis of usage data.
  • Advertising / marketing cookies: these cookies, whether processed by the App administrator or by third parties, allow the analysis of users’ browsing habits on the Internet so that advertising related to their browsing profile can be displayed. Advertising cookies enable the management of advertising spaces based on specific criteria.

These cookies store information about users’ behavior obtained through the continuous observation of their browsing habits, which makes it possible to create a specific profile in order to display advertising based on that profile.

Types of cookies according to the period of time they remain active

  • Session cookies:
    These cookies are designed to collect and store data while the user accesses a website or App. They are usually used to store information that is only relevant for the provision of the service requested by the user on a single occasion (for example, a list of purchased products) and are deleted when the session ends.
  • Persistent cookies:
    These cookies store data on the user’s device and allow it to be accessed and processed for a period defined by the cookie controller, which may range from a few minutes to several years. In this regard, the need to use persistent cookies should be specifically assessed, as privacy risks may be reduced through the use of session cookies. In any case, when persistent cookies are installed, it is recommended that their duration be limited to the minimum necessary according to their intended purpose.

The legal obligations imposed by the applicable regulations are twofold:
the obligation of transparency and the obligation to obtain the explicit consent of the website user.

In accordance with the nature of the business activity, the business model developed, and the scope of responsibility assumed, it is recommended to carry out a review of the cookies used, either internally or with the assistance of specialized entities.

This review shall aim to identify the cookies being used by analyzing whether they are first-party or third-party cookies, session or persistent cookies, and by specifying their function in order to determine whether they fall within the scope of application of Article 22.2 of the LSSI. Taking into account the potential changes that may occur in the management and use of cookies, it is advisable to carry out this review periodically in order to keep the available information on these cookies up to date.
In any case, it should be noted that the solutions implemented to comply with the obligations set out in Article 22.2 of the LSSI must be technologically neutral and, therefore, must be solutions that are recognized by the majority of browsers.

3. LINK FOR COOKIE IDENTIFICATION

It is advisable that the information through which cookies are managed (including how to withdraw consent and delete cookies) be made permanently and easily accessible at all times via the relevant website, application, or online service. For these purposes, and without prejudice to other solutions that may be adopted, this requirement shall be deemed fulfilled when the cookie management system (configuration panel or CMP, which allows website or App owners to obtain, manage, and disseminate users’ consent) is integrated into the Cookie Policy itself, or when this policy includes a link that leads directly to the management system or configuration panel.

These cookies must comply with Regulation (EU) 2016/679 (GDPR), Organic Law 3/2018 (LOPDGDD), the provisions of Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), as last amended on 09/05/2023, and the Guide on the Use of Cookies of July 2023 issued by the AEPD, in accordance with the criteria of the European Data Protection Board (EDPB).
